Welcome to Building Raving Fans. By accessing or using our website, you agree to comply with and be bound by the following Terms & Conditions. Please read these terms carefully before using our website.

1. Acceptance of Terms: By accessing or using Building Raving Fans (hereinafter referred to as "the Website"), you (Client, Customer) agree to comply with and be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not use our services.
   

2. Payment Terms: You hereby give permission to Building Raving Fans, LLC to charge all fees associated with your client activations and/or subscription plan to the Credit Card of File (CCOF) that you have provided, as specified on our website or in communication with you. Payments are non-refundable.

3. Refunds: Payments are non-refundable. No credit (partial or full) will be given for activations that are cancelled at the request of client.

4. Automatic Renewal: At the end of a Subscription Term ("Activation Term"), Gifting Plans will automatically renew for another period equal to the Subscription Term (12 months) unless the client or Building Raving Fans, LLC terminates or elects not to renew the applicable Subscription.

5. Notice of termination / non-renewal: Client must submit notice of termination / cancellation in writing or electronic means no later than 60 days before the end of the subscription term.

6. Auto-Renewal: Top of Mind gifting programs are, by default, set to Auto-Renew at the end of the subscription term. If a customer wishes to cancel the auto renewal, they must inform Building Raving Fans in writing of their desire to cancel the renewal.

7. Collection of Leads: We may collect personal information from visitors who voluntarily submit their information for various purposes, including but not limited to newsletters, promotions, and other marketing initiatives. By providing your information, you consent to the collection and use of this information in accordance with our Privacy Policy.

5. Use of Information: The information collected may be used for marketing and promotional purposes by Building Raving Fans. We may use the information to send you updates, newsletters, and other communications related to our products and services. You can opt-out of these communications at any time by following the instructions in the communication.

6. Disclosure of Information: We may share your information with trusted third parties, such as service providers and partners, to assist us in operating our website and conducting our business. We will not sell, trade, or otherwise transfer your personally identifiable information to outside parties without your consent.

7. Intellectual Property: All content on the Website, including but not limited to text, graphics, logos, images, and software, is the property of Building Raving Fans and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any content without our express written consent.

8. Limitation of Liability: Building Raving Fans is not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your access to or use of the Website. This includes, but is not limited to, any errors or omissions in the content, loss of data, or damage to your computer equipment.

9. Changes to Terms & Conditions: Building Raving Fans reserves the right to modify or replace these Terms & Conditions at any time. Your continued use of the Website after any changes will constitute your acceptance of such changes.

10. Governing Law: These Terms & Conditions are governed by and construed in accordance with the laws of Florida. Any disputes arising out of these terms will be resolved in the courts of Florida.
